This policy statement applies to all deposit accounts.

Our policy is to make funds from your deposits available to you on the first business day after the day we receive your deposit. Electronic direct deposits will be available on the day we receive the deposit. Once they are available, you can withdraw the funds in cash and we will use the funds to pay checks that you have written. Please remember that even after we have made funds available to you, and you have withdrawn the funds, you are still responsible for checks you deposit that are returned to us unpaid and for any other problems involving your deposit.

For determining the availability of your deposits, every day is a business day, except Saturdays, Sundays, and federal holidays. If you make a deposit on a business day that we are open, we will consider that day to be the day of your deposit. However, if you make a deposit on a day we are not open, we will consider that the deposit was made on the next business day we are open.

LONGER DELAYS MAY APPLY

In some cases, we will not make all of the funds that you deposit by check available to you on the first business day after the day of your deposit. Depending on the type of check that you deposit, funds may not be available until the fifth business day after the day of your deposit. However, the first $100 of your deposits will be available on the first business day after we receive your deposit. If we are not going to make all of the funds from your deposit available on the first business day after we receive your deposit, we will notify you at the time you make your deposit. We will also tell you when the funds will be available. If your deposit is not made directly to one of our employees, or if we decide to take this action after you have left the premises, we will mail you the notice by the day after we receive your deposit. If you will need the funds from a deposit right away, you should ask us when the funds will be available. In addition, funds you deposit by check may be delayed for a longer period under the following circumstances:

• We believe a check you deposit will not be paid.
• You redeposit a check that has been returned unpaid.
• You deposit checks totaling more than $5,000 on any one day.
• You have overdrawn your account repeatedly in the last six months.
• There is an emergency, such as failure of communications or computer or communications equipment.

We will notify you if we delay your ability to withdraw funds for any of these reasons, and we will tell you when the funds will be available. They will generally be available no later than the eleventh business day after the day of your deposit.

SPECIAL RULES FOR NEW ACCOUNTS

If you are a new customer, the following special rules will apply during the first 30 days your account is open. Funds from electronic direct deposits into your account will be available on the day we receive the deposit. Funds from deposits of cash, wire transfers, and the first $5,000 of a day's total deposits of cashier's, certified, teller's, traveler's and federal, state and local government checks will be available on the first business day after the day of your deposit if the deposit meets certain conditions. For example, the checks must be payable to you. The excess over $5,000 will be available on the ninth business day after the day of your deposit. If your deposit of these checks (other than a US Treasury check) is not made in person to one of our employees, the first $5,000 will not be available until the second business day after the day of your deposit.

LIMITS ON LIABILITY:  Unless you have been grossly negligent or have been engaged in fraud, you will not be liable for any unauthorized transactions using your lost or stolen Visa card.  This additional limit on liability does not apply to ATM transactions, to transactions using your Personal Identification Number which are not processed by Visa, or to commercial cards.

SPECIAL ERROR RESOLUTION PROCEDURES FOR POINT-OF-SALE TRANSACTIONS (OTHER THAN FOREIGN-INITIATED TRANSFERS):  In case of errors or questions about point-of-sale transactions using your card, call or write us as described in the ERROR RESOLUTION NOTICE in our disclosure entitled “ELECTRONIC FUND TRANSFERS – YOUR RIGHTS AND RESPONSIBILITIES.”  We will determine whether an error occurred within 5 business days after we hear from you and will correct any error promptly.  If we need more time, however, we may take up to 90 days to investigate your complaint or question.  If we decide to do this, we will credit your account within 5 business days for the amount you think is in error, so that you will have the use of the money during the time it takes us to complete our investigation.  If we ask you to put your complaint or question in writing and we do not receive it within 10 business days, we may not credit your account.



Visa® Business Check Card Disclosure | Top of Page |

The VISA Card enables a cardholder to perform certain banking functions through the use of a banking machine or a POS transaction.

The terms of this agreement are subject to applicable Federal and State laws and any regulations issued thereunder may be amended by the issuer from time to time by giving the cardholder reasonable notice of said amendment.

You and any Cardholder agree that this Card is for use by business owners and employees.  The Card can be used for business transactions only.  The Card may not be used for personal purposes.  You acknowledge and understand that the Card shall not be treated as a consumer card under the provisions of state and federal law.  You agree to provide instructions to all Cardholders that the Card shall not be used for consumer purposes.  We do not monitor transactions to determine their purpose.

All transactions initiated by the use of the VISA Card shall authorize the issuer to process and complete the transaction in accordance with the instructions given by the cardholder for which the Business shall be responsible.

Issuer may withdraw cardholder’s privilege to use the VISA Card at any time without notification and retake possession of the Card.

Either Issuer or cardholder may terminate this Agreement at any time.  Upon termination, Cards shall be returned to the issuer.  However, such termination shall not affect any transaction commenced through the use of the Card prior to its return.

Our policy is to post and pay Card transactions in the order they are received.  We reserve the right to pay Card transactions before checks and other items.

You should retain copies of all records including receipts, credit slips (for returned merchandise), and cancellation numbers (for cancelled reservations).  You should also mark each transaction in your account record (but not while at a terminal).  You should review your periodic statement for accuracy and compare your account record against your periodic statement to reconcile balances.  You will receive a monthly statement from us for your checking account that will also include a record of transactions made using your card.

We will not be liable if: you do not have enough money in your account to make the transfer, you have an overdraft line and the transfer would cause you to exceed your credit limit, an ATM does not have sufficient cash, a terminal or system is not working properly, circumstances beyond our control prevent the transfer, a merchant refuses to accept your Card, or an ATM rejects your Card.  There may be other limitations on our liability.

You will not have the benefit of any consumer law limiting liability with respect to the unauthorized use of your Card.  You accept and agree to undertake the additional risk and greater measure of liability associated with the use of business purpose cards.  You are liable for Card transactions you do not authorize if we can prove that we possessed the transaction in good faith and in compliance with a commercially reasonable security procedure.

Tell us at once if you believe your Card and/or code has been lost or stolen.  Telephoning is the best way of keeping your possible losses down.  You could lose all the money in your account (plus your maximum overdraft line of credit).  If your Card and/or code is lost, stolen, or used without your permission, you agree to notify us immediately and to promptly confirm such notice in writing.  Your liability for transactions with your Card and/or code will continue until 2 business days after the day we receive such written notice.

We will not be liable for any consequential or incidental damages resulting from the unauthorized use of your Card.

What this means for you: When you open an account, we will ask for your name, address, date of birth, and other information that will allow us to identify you. We may also ask to see your driver's license or other identifying documents. Thank you for your cooperation.
